ALLEGED THEFT OF COAL.
At the Magistracy yesterday before Mr. Melbourne the coxswain and a number of the crew of the steam launch Arolue were charged with stealing two tons of ecal from the launch, the property of Holt's Blue Funnel Line. Mr. LewİK, from the office of Messrs. Jokingon, Stokes & Master, appeared to prosecute, and Mr. Leo d'Almada appeared for the de-
fence.
After evidence had been heard, Mr. d'Almada submitted that there was no evidence of theft. The only thing that could be proved from the evidence was that on two diccasions the defendauts had taken out the launch after midnight.
Mr. Lewis replied that if that were going to be the defence he could amend the charge to one of fraudulent conver- sion.
Mr. d'Almada argued that Mr. Lewis could not take that course after the case had gone so far and after evidence had been taken..
His Worship hold that Mr. Lewis was ithin his rights.
A charge of fraudulent conversion was thereupon added to the original charge. After hearing Mr. d'Almada's state- ment for the defence,
His Worship said he believed there was a case to answer, but he did not think ho could deal with the men under the section. if they were found guilty.
Mr. d'Almada asked for permission to consult his clients as to what they should
do.
This was agreed to, but no decision was arrived at, and the application of Mr. d'Almada for a remand until to-day was Franted.
