I am of opinion that under the peculiar circumstances of this case, a surrender in writing by the petitioner and the personal representative of the late Mr. Pope, may be accepted; Provided that on search in the Registry Office, it appears the parties have not done any act to affect the lands, or incapacitate them for surrendering.
