was issued at which date no record of the resumption the Treasury, and as I have of the ground erricted in said above, I am not aware that the ground has been actually resumed by Government.

In the beginning of September 1847, the rent of these lots, No: 155, 156, 157, and 158 under the conditions mentioned in this letter were received and paid into the Treasury; the Acting Attorney General having stated, subsequent to his memorandum on my letter, that the Government would publish in the China Mail the resumption of these lots, with others, as was done on a former occasion.
This ground was not purchased by Messrs White and Oswald, but was set apart for them in lieu of some which the Government required, and was never taken possession of by the parties; for which reason they intended to defend the actions, but made the offer of payment solely from their desire to avoid a law suit, in which even should they succeed, they would be losers in the costs of defence. And under these circumstances the Acting Attorney General advised me to receive the rent and pay it into the Treasury.
