It is a splendid representation of the expan- sion in business and the infinite variety of imports that characterizes the local feld at present. K. TRUDZURABARA, ManxP*T. Hongteng, 1st May, 1911.
In the course of their annual report, the Committee of the Liverpool Underwriters' Association refers to the effect of the Maritime Conventions Act 1911, which became law at the end of last, Session, The Act, gives effect to the two International Conventions relating to collisions and salvage which were signed in Brussels in September, 1910. The Committee think it well again to state that, they take no exception to the legalization of the Convention concerning salrage, as that Convention makes no change of importance in British low, but they feel it their duty to take strong exception to tho change which the Act effects in the Law of Collisions, us
they consider that substan- tial grievance cristed in the operation of the old law, under which, where both ships were at fault, such was inade to bear half the lossYOKOHAMA
incurred.
BO
The new law decreos that the damages to be paid by each vessel shall be in proportion to the messure of blame attaching to her, bat in casoa where it is not possible to ascertain the degree of fault applying to each vessel the damages eball be borna equally as heretofore. In the opinion of the Committee this new method of apportioning the loss will not only increase litigation, but in the majority of, erses it will be impossible to apply it with any degree
accuracy. The proportional method is al ready in existence in several foreign countries and, according to information furnished to the Committee, the general experience is that Judges are frequently compelled to fall back on the simple expedient of dividing the damages equal. ly where both vessels are found in fault,
of
It is stated that the only remaining points to note are (1) that the Maritime Conventions Aot does not extend to Canada, Australis, Now Zealand, South Africa, or Newfoundland though otberwisa applying throughout the British Dominions; and (2) that the question of the abolition of the statutory defence of. com. pulsory pilotaga remains In abeyance,
