The loose manner in which Mr. Farrant, the late Clerk of deeds in the Office of the Surveyor General, has performed his duties with regard to the suit against Livingston, has led to the error upon which grounded, as Mr. Tarrant appears to have acted solely upon his own responsibility and without reference to authority from the Surveyor General. Under Mr. Tarrant's present circumstances I have not called upon him to make good the loss to the Government arising from his carelessness.

Extracts from Secretaries dated the 27 and reporting the repayment to MM. N. D. E. Parker, the Crown Solicitor of Hong Kong, of the sum of $52.50 paid by him into Court on account of fees in the Suits instituted by the Crown against Livingston and Ching Cheong.

These documents do not enable me to form any decisive opinion upon the propriety of the course pursued on this occasion by Sir John Davis.
