Mr. Norton said both, the petitionor and res- pondant had been members for some years past of the Baudmanu Opera Corapany. The poli tioner was married to the respondent on the 8th of March, 1962, at the Registry Office at Sheffield, and there had been one child of the marriage. bora in Maroh, 1904. The child died in November, 1904. After the warring the potitioner and tho respondent lived together in various places, and from the month of February, 1908, to the mouth of February, 1909, were in Calentto. In the months of May and August, 1909, the respondent misconducted himself with one Mrs. Baby, a ballet mistress to the children in the Theatrical Company of which the patitioner and the respondent were then members. At the end of th year 1909, on the earnest entreaties of the respond the petitioner forgave him and they nguín lived together. Afterwards, between tho months of December, 1909, and February, 1910, in Calmatta, the respondent grow very friendly with Mian Hebe Kneller, of the Hand- mann Company, and when the petitioner remonstrated, respondent pushed the pelitionge violently against a pillar and 'severely hurt her head. Thereafter, her husbandi throstoned and insulted her, openly exhibited his proference for the said Miss Kolber, and neginated the peti- tioner, Between December and January, 1910, the respondent remained out all night refus ed to give any explanation or reason for his absence except that on one occasion he admitted that be had visited a house of ill-fume. In apite of the expostulations of the petitioner and other members of the Company, the respondent con tianed his relations with Misk Kuoller. Whils they were at Shanghai on May, 1910 the respondant sized the petitioner by the throat and threw her violently to the ground, and since then they had lived separately.

LETTERS EBAD.

Counsel next real bro letter received by the petitioner from the respondent, one before and the other since the institution of the divores proceedings, and also read the judgment of Mr. Justion Harington, which said, Her evidence was given in a frank and straightforward manner, and I have no doubt that each fast to which she spoke was truly stated by her, but the guration. is, aro the facts she has proved suffident to justify the inference that on any pao of those occasions she has spoken to adultery was cont mitted.

JUDGMENT.

Mr. Justice Woodroffe, in delivering jadg ment, said that in this ease the petitioner asked for the dissolution of her marriage with the rospondent, whom she had charged both with misconduct and eruelty. The respondent had been sorved with notice, but had entered no de- fence. It had been proved in this case both by docamentary and oral evidence that the respon- dont had misconducted himself.
