! September. The point his Lordship bad to dooide was whether it was material to the inso if the forgory took place on the: 13th, and if it was not, the one could not be proceeded with against the defendant. At no BEFORE HIS HONOUR MR. W. FEES DAVIES time would the question of September 13th become material to the issue. Never at any time in the Police Court, was the defendant challonged as to his memory with reference to this date, and even when he appeared at the Supreme Court to give evidence, learned Counsel for the defence did not ask him whether he was correct in saying that the forgory took place au September 13th He did not know whether the Crown was going to suggest that it was material to the case of forgory to insert

Mr. Alabaster, in opening, informed the Court and jury that both prisoners wore charged with kidsapping a child five years of age, and the infant had not been recevored. The parents would slate that they missed the child on February 15th, and a small playmate would say that he saw the male defondant carry the obild away. On April lat the father met the male defendant and accused him of having kidnapped the chill, and he admitted it. The father then waid that there must have been someone else working with him, and the first deferlant said there was a woman in it. When the father subsequently met the woman she ad- mitted being concerned in the kidnapping and at the Police Court later both virtually admitted the charge, but now one tried to throw the blame on the other.

The prisoners were members of the crow of a junk, and deceased was a member of a party of coolies connected with the loading or unloading of a junk. In this loading a springs plank was used, and was objected to by the coolles.
