ANOTHER HAREAS CORPUS APPLICATION. Another application for habeas corpus was presented by Mr. M. W. Slade, instructed by My Otto Kong Bing. In this, the Captain Superintendent of Police was called upon to show cause why Sue A Wan, at present de taiked in Victorial Goal, should not be delivered from custody. Mr. M. Blade, instructed by Mr, John Hastings, of Messrs. Hastings and lastings, sppeared to move for a writ of habeas corpus in respect of Sung Yati Chi, a Chines woman drained into show cause. Hongkong gaol, and whe, secording tos declara- tion made by her brother, had lived all her life in Hongkong.

Mr. Slode moved for a rulo direcul to the Captain Superintendent of Police to how cause why he should not bring up the body of Sung Yau Chi bofore the Court to be charged from custody. She was arrested three days ago or an administrativo warant. An order for banishment had been made against he. but no legal proceedings had been taken. She had simply been arrested sul was detelned not Bolmily in gal but at the Cental Police Station. An order banishing her for Üve years had been made against ber and she was about to be deported from the Colony. There were several Ordindices dealing with the question of banishment, the most important being Ordinance 1 of 1992, section 4 of which gave the Governor-in-Coquell power to banish an alien for five years. Under the Gambling Ordinance the Governor-in-Council lad pover to make an order of banishment for such period as might think ozpediant, against my alion who was a professional gambler or who was engaged in the promotion of garsing. Tho reason given for the deparation of the woman was that she was concerned with gaming. Both of tis sections quoted confined the power ofhanish ment to aliens, persons not being notuml-born British subjects. The adiviis made it clear that she was born in Hongkong. She was born before registration.

The affidavit signed by prisoner was the effect that on June 10th last he was arrested on targes of armed robbery and murder alleged to have been committed in China. He was brought before Mr. J. B. Wood, and remanded from work to week until July 9th, pending, as he believed the arrival of witnesses for the procution. On July 9th he was brought before the Magistrate for thepurpose of identification, but if the two witnesses called for the prosecu tion one failed to identify him and the other was doubtful as to the identity. Subsequently he was informed through bis soliciter that it www.proposed to discharge him on the charge of manor. On August 4th he was brought before the Magistrate, presumably to be discharged, but he was again remanded because the necessary requisition for his surrender had not been made by the Govora. On August 10th ho was discharged on the sharge of murder. The Court sat within the precincts of the gael and not in the Police Court.
