Morrell from the Crown Solicitor's office, appeared on behalf of the Crown, and Bir Henry Berkeley, K.C., instructed by Mr. Otto Kong Sing represented the prisoner.

Sir Henry Berkeley stated that there had been filed on behalf of the fugitive from Chius, In Kai-shing, who was detained in Victoria Jail, a notice of appeal from a decision of Mr. Justice Wise refusing an application for kabeos corpus. There had been concurrently fled a substantive notice of motion before the Court In its original jurisdiction to grant habenicorpus. It would be for him to satisfy the Court that the procedure was ra ular, that the Court had the power to catertain the appeal, and also that it had the power alternately to atartsin the motion for habeas corpus, As Couneel intonded to raise questions which he had not raiset on the appeal, most important and far reaching pointe, he would prefer their Lordships to treat the matter as a motion for the granting of a rule for habeas corpus. ́: He could then bring before the Full Court points he had not anbmitted to the individual judges.

Unless auch validity were given it by the Imperial Government, as in the case of the Merchant Shipping Aot, the Colonial Legislature was subordinate to ite obarter, and could only legislate within the limits described by the charter and for the pence, good order, and good government of Hongkong, within the limits of the territory of Hongkong."
