AN AMERICAN BANKING CASE. The Cabinets of Oct. 27th reports: --Fudge Sweeney rendered a decision yesterday in the petition of H. L. Thiven, praying to be declared owner of the son of $281.73, which J. L. larrett, ne receiver of the American banic, holds in trust for him. The petitioner alleged that

December 22, 1904, ha place with the American bank. for collection, a pass book on the Greenwich bank of New York, evidencing an indebtedness of 950 sail interst of $11.50, aggregating S261.71, together with an order American bank and sain, and that mid order was on and bunk to pay to the order of the endorsed by the American bank to Kutzo Brethera, of New York, the correspondents of the American bank, which book and order wers forwarded to Kuntze Brothers for collection, ad that the American bank took credit for and charged to Kuntzo Brothers said 3261,71. The court held that petitioner is not entitied to priority in payment of his debt that it is merely a lobt against the bank; that his claim is not superior t that of any other cre litor. and Bads plaintiff entitled to a pro rata with the other unproferrod creditors of the American bank.

With reference to plaintiff's claim that the $261 is a trust fund and that petitioner did not part with his title thereto, the court says: The owner of property may trace it and recover it from suy ano, anywhere it can be found. "SACHSEN," baving arrived, Consignees of Carge are hereby informed that their Goods, with the exception of Opiam, Treasure and Valcables, ure being landed and stored at their risk into the hazardous and/or extra hazardous Godowns of the Hog hong and Kowloon Wharf & Godown Company Limited, Kowloon, whence delivery may be obtained.

Optional Cargo will to forwarded unless notice to the contrary be given before 11 r.. Ta-day.

No Claus will be admitted after the Goods bave left the Godowns, and all Goods remaining undelivered after the 6th November will be subject to rent.

All broker, chafed, and damaged Goods are to be left in the Godowas, where bling will be examined on Monday, the 6th Novembor, at 9.80 A.M.

All Claims must reach us before the 11th Notomber, or they will not be recognised.

Na Fire Insurance will be effected. Bill of Lading will be countersigned by the undersigned,
