Mr. Sharp said: -The eridence enlied is equally applicable to the second action between the same parties, Action No. 82 of 1904. As the contracts are identical in each case, when this caso comes on for trial the evidence may be read. JUDGMENT,

In giving Judgment His Lordship sald-I do not think I can do anything else thasi giro jadgraout for the plaintifa for the amount claimed, for the reasons are so obvious. They had, in effect, postponed the date of the breach of the contract till the date when the plaintiff withdrew forbearancs and insinted ou delivery.
