to decide was, to what portion of the disputed reclamation Yin Chow was ontitled us froutager His answer was the whole." That being so, had Yin Chow or had the plaintiffs as his representatives so conducted themselves in the matter as to make it unfair and invynitable that the defendnuts should be ho'd trustees for the whole? It seemed to him that. if the plaintiff were willing to refund with interest at 8 per cent, the $2,000 paid by Chu Chuon to Mr. J. D. Stephens and the money contributed by Chu Chuen and the defendants towards the cost of making the Praya, he ought to decres that the Crown Lears of the whole disputei portion of the Reclamation ought to be grante'l (on payment of any further contribution that might become due final settlement of the Praya Reclamation accounts) to the plaintifis or, if granted to the defendants, that the land west be hold by there in trus: for the plaintiffs.
Mr. Shule in his argument contouded that by not entering into the reclamation agreement within the time limited by the Reclamation Ordinance Yin Chow, the predecozzor in title, gave up every legal right that he had. under that Ordinance. What the Court had to do was to construe the undertaking with rofer- ence to this land and to say what amount of the reclamation should be assigned to the respond- ents under the limitation.
Mr. Sharp said the defendants had contended from the beginning that the back section hold- ers were not entitled to the frontage. The question for their Lordships was what was the meaning of the words "equitable proportion in the Ordinance.
After a discussion which lusted all day the ease was adjourned.
