THE GOMEZ CASE.

The sequittal of Dr. Dominador Goweż anıl Buenaventura Kabalza created somewhat of a surprise hero, although those who have followed the case closely and studied it from a legal stand- point assert that it was only to be expecteil. Such a mass of evidence, all of a strongly prejudicial character, has been introduced during the wearisome thrashing out of testimony. that the ordinary nowspaper-rending public had come to take it for granted that conviction maust -- follow. While the evidence of the prosecution leaves litilo room to doubt that Dr. Gomez wa

in opposition to the Government, in this particular cans it seems that it did not sustain the special character of tho cierge. As the decision of Judge Ambler explains, the evidence on the corut, of conspiring to raise a rebellion and that of treason, though insufficient, was enough to demand bis censure. Judge Ambler rulod that there was not enough evidenes to convict the acensed of conspiring to raise à rebellion, and that treason against the United States consists only of leging war against them, adhering to their onemtes, or giving aid or comfort to them. The decision points out that insurrection and rebellion are synonymous, aud that both are treason. It follows, therefore, that if the former effonce had been proved the latter would have been established. Law in the local law, fassmuch as it is commonly This finding would indicate that there is a
