CLAIM. TJ A GROWN BASE. Chan Ut Chin and Pan Kon Shan brought an action against Chu Lee and Chu Ping in respect of the right to the ownership of a Crown lease on the old Praya. Hoa. H. B. Pollock, KC, barrister-at-law, and Mr. E. H. Sharp, K.C barrister-st-inw (instructed by Mr. R Harding, of Messrs. Ewens and Haraton, solici tors), appeared for the plaintiffs, and Mr. M. W. Blade, barrister-at-law (instructed by Mr. H. J. Gedge, of Messrs. Johnson, Stokes and Master, solicitors), appeared for the defendants.
In the statement of claim the plaintife stated that Chan Ut Chiu was compradore to

In delivering judgmenthis Lordship remarked that in the matter of law this wiss care of y falau qualited privilege, in his opinion. Plaintiff had failed to prove that the writing of the letter was an act of malice. He found that defendants had shown reasonable grounds for making. To balance at debit on Sint Ansumber, some allegations, and with regard to other allegations they had shown reasonable grounds for believing them. His Lordship accordingly gave judgment for defendants and costs.

THEFT AT THE KO LOON DOCK,

Inspector Langley prasecatul on behalf of Mr. W. W. Davison, Foreman, two Chinese carpenters employed at the above docks for the theft of some brass locks and Attiugs, the property of the Dock Company. They were both convicted and sentenced to 2 months' hard labour and 3 hours in the stocks each.

would grant a Crown lease of all anok portion of the reclamation provided for by the Ordinance as was delineated on the plan and coloured red for a term of 999 years. The part coloured red showed the reclamation appertaining to Sections Band D of farine Lot 58A was an area of land which measu.ed 5,859 square feet and extended right through the reclamation from front to back and had a frontage on the now Praya of 41 fest 6. in. The articles of sgres- ment although they were nominally entered into by Chu Chuon in his own name and on his of the owners of Sections B and D of the lot, and were so entered into in purseance of the custom of the Hongkong Government in the case of reclamations which were made under the Ordinates of entering into such articles of agreement for raclamation with the Crown losses of any lot in rospect of which any reclamation had to be mode. At the data of the articles one Yin Chow was ownbr of Sections B and D of the lot, but Tiu Chow died on 21st May, 1893, and plaintiffs were now the owners of Sections B and D, having acquired the same by purchase, under an indenture of assignment dated 12th September 1800, from oue Lo Ah Sam, who was the executrix of one Kwok Kwal, executrix of Yin Chow. By virtue of this serignment, which included a conveyance to the plaintiffs of all the estate, right, title and interest of Lo Ah Sam as executrix in the ploces of ground or extension seawards known or registered in the Land Office as the reclama. tion of Marine Lot 59A, the plaintiffs became entitled to that portion of the reclamation to the lot which was coloured red in the plan annexed to the articles of agreement In the 1640 alternative plaintiffs said that, altogether apart from the articles of agreement, the plaintiffs, as owners of Sections Band Dofthelot were entitled, upon the trop construction of the Ordinance, to such proportion (from front to back) or the whole of the reclamation to Marine Lot blå a the frontage of Sections B and D of this lot upon the old Prays roadway (now known as Des Voeux Road) bere to the whole frontage of the lot; that was to say, the plaintiffs were entitled to the area of land coloured red on the Chu Chuen died on 25th aforesaid plan. January, 1893, and probate of his will was on 7th January, 1899, granted to defendants as executors. The portion of the works in the area of reclamation described as Seotion 6 had been sum of completed and the whole of the 812,759.54, being the cost of the reclamation in respect of Sections H and D, bad been paid to the Government, namely $11,164,60, by Chu Chuen or by defendants as his executors, and 81,094.94 by plaintiffs, Plaintiffs were read and willing to pay defendante the sum of $11,164.60 with interest of 8 per cent, per annat from the respective dates on which the respective прой instalments were paid to the Goverument the plaintiffs being adjudged by the Court or admitted by the defendants to be entitled to the portion of the reclamation coloured red on the plan.
