SIQUEL TO A COLLISION. There was called a cross action arising out of a collision which occurred on 22nd November about half-past three in the morning in the China Sea about 100 miles N. of Hunan Island, between the French ss. Eclair and the Portugno & Hot-kiang, while the Eclair was going to Kwanchanwan and the Hoi-kiang coming up to Hoogkong, as a consequence of which the latter vessel Bank in deep watering in Belgium in 1900, and the former was seriouely damaged.

Mr. E. F. Sbury, K.C. (instructed by Mr. F. Fagot Hott of Messes, Mounsey & Bratton, solicitore), appeared for the Eclair ard Mr. T. Morgan Phillips, harristar-at-law (instructed by Mr. G. C. C. Master of Measta. Johnson, Stokes & Mester, solicitors), was for the Hoi hang.

Mr. Sharp, in opening the case, said it was one of exceptional simplicity. The whole case was the courses. The Eclair in her answera attributed the fault of the collision to the Hoi-kieng, on which, it was alleged, no proper look-out was kept; the Hoi-king tuproperly starboarded her halm tried to pass on the wrong side of the Ector, was navigated in a generally reckless and woseamanlike manner; and she violated Articles 18 and 20 of the Regulations for Preventing Collisions at Sen. The Hot-kiang stated that insuficient look-out was kept on board the Eclair, that the Elair improperly altered her course to starboard, endeavoured to cross the Hui-kiang's bow, and did not stop and reverse her engines. The Eclair, Mr. Sharp went on to say, carried crew of 34 all told. She was 110 tons burdon, 120 foot long and the height of her upper deck was about 12 or 13 feet above, th level of the water.
