Loe King, Government coal contractor, was charged, on remand with forging a receipt for a ton of coal. He pleaded not guilty, and was defended by Mr. H. W. Looker; Mr. F. B. L. Bowley, Crown Solicitor, prosecuted.

The plaintiff stated in his petition that shartly before 8 p.m. on the 14th January the junk Yee Fung, of which ho was the owner, whilst on a voyage from Canton to Hongkong, emerged from the Hongkong end of Capauimun Pass. The wind was north-westerly and light. It was a moonlight night with clonds over the moon, and it was clear on the water. The tide was about three quarters food and was running up at the rate of about three-miles an hour. The Yee Frong was sailing under two of hor three sails which were spread out on opposits sides of her, and she was heading S.E. and at such a pace as only enabled her to make very little headway against the tide. A proper white light was carried at her formusthead, and a good look-ont was being kept. Mr. Looker submitted that there was absolutely no case against the defendant, nor evidence upon which any jury would convict anybody on a charge of that description. The only statement as to uttering a forged receipt was that when the defendant handed in a bundle of receipts all tied together one was found to have been altered, but there was no evidence to prove that he know it had beon altered. The prosecution had not made ont even a prima facie case, because in s prima facie ense they would have to show that the accused know the receipt had been altered.
