In this case Mr. B. H. Hazeland, architect, was charged with infringment of section 70 of the Building Ordinance of 1895.

The prosecutor in opening the case said that section 70 of the Building Ordinance of 1895 states that no one can commence building or alter or add to a building without first giving notice to the Director of Public Works and obtaining his approval. Suck potico must be signed by the owner, ocoupler, or agent of the building in question, and the said owner, oompier or agent is responsible for any act, failure, omission or neglect occuring. Des fendant had signed the notice na agent, and responsible for any consequently was Works carried ant in contravention of the Ordinance. It was not necessary for the prosecu tion to prove that the agent caused the neglects or infringments of the Ordinance; it was merely necessary to prove that they occured. Now defendant had sent in a notice to build an additional story on houses Nos, 23 and 25, Stone Nallah Lane. Those houses had been two-storied before and verandahs were to hé udded to the second story of both houses. Plans were submitted for the additional story and another for the verandahs with the notice which was dated 1st August, 1901. On the 28th of September Mr. Tooker, Acting Director of Pabbe Works, visital the place, and found firstly that in the party wall between houses No. 23 and 25 on the second story, which the plan showed to be solid, a rectangular opening, 5 ft. 6 in. wide by 7 ft. 6 in. long, had been made.
