Mr. Ross deposed that on the lith inat he visited the defendant's house and found in a bath room a copper pipe loading to a heating upparatus.

Cross-examined by the defendant-He bad boen to the house on two occasions, the first time

about a fortnight before the 13th. The water authority was the Director of Public Works. occunt is but his subordinate. Mr. Hollingsworth, was the one from whom complainant took his orders- Ha notified Mr. Hollingsworth before taking out the summons: Complainant was told that defendant had written aboutthe waterservice, and that Mr. Ormsby and Mr. Hollingsworth were considerably annoyed. The copper pipe was 2 of un inch in diameter. The “T” piecs was con neated immediately bobind the main pipe, which allowed the water to flow directly into the bath. On this. "T" pisos, was a stop-cock which, when turned on, let the water into the liestera gis one. If both cocks were turned on the water would only trickle through the Per pipe. Complainant did not know if it was necessary or usual to give notica before a person was summoned,!' -

Mr. Mounsey complained of the manner in which the summons had ben eerved. Although the officer who served it knew that he had an office in town, yet he must needa take the tromble, in order to indict as mach annoyance as posible, to go to his (Mr. Mounsey's) house and hand the summons to a 100,000.00 Chinese sorant, when the law demanded that 1,923,767.16 a summons should be served personally. As to 5,547.99 the charge contained in the summons, the pipes 27,215.08 not the water-heater were pat into the house 204,651.70 by the Government itself. He bought the

The Gur- ernment knew perfectly well the heater was there; it had been there for two months, and yet they had not thongút fit to issue summons or take any steps whatsoever until now. The pipe connecting with the heater was the smallest pipe that could possibly be got, aul was not tixed to the main pipe in any way, nor did it extend the water service in the slightest.

The C. P. R. sterner Empress of Japan se rived at Shanghai at 10 a.m. on Sunday, the 17th inst., and left again at 8p.m. a day for Hongkong, where she is due to arrive at 9

A Sikh constable stated that he was on duty on Saturday night at the Circus, and saw.

the defendant get into the complainant's rick sha. The letter objected to his passenger, who then struck him a blow on the nose, causing it to bleed. The defendant was slightly under the influence of drink.

A fine of $3 was inflicted, and paid.
