Of course this does not mean, and ought not to mican, reckless expenditure; but it must mean that the new Court to to be constituted with a view te the utmost possible oficiency, and not mere ly with the idea of getting-the-beat-tribunals- tlaban be got at the price now paid.
After aun assurances there was to mow for opposition, and the Bill was gut a second time with cordial ananimity. The arbordinate question, whether the important amendments bion are promised shall be settled in Select Committee or in Committee of the whole House, 1rged merely on soosiderations of conveolence Thera is much work to be done, and we are not quite are that it would not be done more rapidly over a Committes Room table than on the floor of the House, Tliere a weight, how ever, in Mr. Walkin Williams's observation, that it would be very difficult to get the lawyers together in the morning, and in the present topper of the House wo any fairly count upon a fall d'acnxsion of the chates when the Hanse
its into Commit.ce. It is a great point gain- ed to have nearly all questions of principle absolutely concluded. The Attorney-General not only conceded, but veloomed with gaine enthusiasm, the proposal that the Common Law Division should be strengthened from the ontact with infusion of Equity trained colleagues, and he was able to convey the astraise that this was desired by none more keenly than by the Common Law Judges tlemiselves,
Ga the constitation of the Court of Appes! the nesuances of the Attorney-General efe equally satisfactory. The porenent staff is to inciale tires Equity Judges in addition to the Lords Justices. This will make a well-balanced Court, though it may be doubted whether they wil und time to get through their work with- out splitting themselves into inconveniently emall division. The questions of the amanat of strength wich wrist be plotted to the Chan- eery Ditision to make it capable of dealing civity with the work assigned to it, has not yet been fully diaanseed, but no one impugned the broad principle insisted at by Mr. Fowler, that Buch strength shanid be given as to ensure the introduction of vird soos evidence, to save the jury' bot from being once more consigned to the luaber room, and to get rid of the ecandal of delegating Judges' work to Chier Clerks in Equity and to Registrars in Bankruptcy. Amandments with these objecta ought to b and no doubt will be, jealously watched to gaurd against exocas; but we may assume after what has passed that whatever is clearly shown to be essential to efficiency will be granted without demur.
We have indicated these as among the most important points to which the labor of the Committee will have to be dirested--not at all
axbausting the abjecta on which amend ments may be called for. The whale subject of references, to which Mr. Henry Matthews spesially directed attention, will need much care

One very important matter-that of pro- ocduro will require a good deal of careful and rather minute attention. II a plaintiff to have the option either of commercing proceedings by writ, to be} Ox followed after the defendant's appearance by a printed statement, or, if he prefers it, of serving both atstament and writ in the first instancë, and moving, it may be, for an injonction without an bear's delay? We can see no reason why it should not be open to a plaintiff to chcuse the one or the other method according te the Tture of the cane which he brings before the Corrt. But whichever way it is determin. ed, the point ought to be settled by the schedule.
IL-Ar pleadings to "open picadings," that is, plain statements of fact, or are they to baissable pleadings" in the technical Dense as they are to be framed so as necessarily to lead to defnita specific io- st, and to be subject to the old roles of special pleading by which this end is secured ? This is question of primary importance, and for many reasons we are satisfied that the Judi. catura Comission was right in deciding in favour of open pleading. The great value of it is, that it ensures all the facts being before the ' Court, and almost excludes the presibility of a look-wo to travelling trader. saitor's arise being Just by a slip oo the part, of a pleader. The objections arged against It are, that it loads sometimes to prolixity, and that it does not produce ready-made issues For a jury to decide upon. The first of thema defecta may be readily cured by punishing undus prolixity with costs, and the other by adopting the practice which has answered so well in the Divorce Court, of always trying causes on specific issues prepared by the parties, aad estled in case of difference by the Court. On tas other hand, the marit of Lable plea
g" that it is thoroughly scientific, or rather was so before the Gomson Law Pmoe duro Acts tampered with it, and that it does in tory any rate necessarily lead to definite jave. Unfortunately, these issues are too often general iasace, under which juries decide upon mixed facts and law, and the scientific precision of the method is only attained by the suppression of the real facts until the buùc of tril and by the consequent risk of failure either from surprise or from a pleader's want of skill. One more consideration which seeme to us conclusive in favour of open pleadings followed by inanes settled by the Courts is, that Serdicts world then always resemble spocial verdicts, and we should escape the scandal of rew trials for misdireation. It is very coon. strous that when a Jodge lays down the law wrongly at Nisi Prins there should in many
