It was mortgaged to the late firm of Dent & Co., of which I was at the time'a partner. I recollect the old line of road in 1864. It went up to Mr. Hogg's fance and alongside of it, and round with a sweep to the bridge.
It was not the same se now, nor the same s0 the road claimed by the defendant. Mr. Hogg came to me several times in 1867, 68, and '69 aboot parchasing the land. After the farm had heen bought by Mr. Little, Mr. Hogg came to me and asked for my exuction to make an alter ation in the road which would be an improve ment to his property and to Jessfold. I paid I had no objection if Mr. Little had not. and I said I believed the straightening of the road would be
advantage. He went to Mr. Little, who gave his consent.
The road is not in that position now. I know of no other rond approaching Josefield. I have gone only by the original road, by that abolished a year and a ball" sgo, and by the present one. which were all aerose the same piece of ground, It. Ubarch, sworn, stated-1 am tanant of Jensfeld, and have koown it since the anturan of 1864. 1 know of no other approaches by road except the one nereas this land. There is away by going over felda and between two Tillages, but no read. I have been tenant all the time since November 1868. The road was straight across the bridge; the present road is not the same, and it is very much worse, that the previous one,very incoúrenient. It is a cafe road, not dangerone I was at Jefald on 17th Deo, last, when wint Mr. Coutis described took place. Mr. Little ordered bis gardener to pull away the fence. He did so.
