In reply to this application I am directed to remind you that the tenure on the lot you will be permitted to hold the first selected lot still awaits the decision of Her Majesty's Government, the permission for your making that selection was at the time given on express understanding that the land should be held subject to such conditions as might be thereafter imposed, and in conclusion I am directed to say that it is out of the power of the Government of this Colony to comply with your request for exchange of the lots, as the Magistracy has been included in the Return of bona fide sales, which was lately forwarded to Her Majesty's Government.
