Silvery Dawn.........
Mr. Wotton said the oharge was brought nuder Ordinance 22 of 1887, sections 11 and 19. As his Worship was aware the Opiam henr paid a large sum as Government for the monopoly of prepacing and storing opium within this colong. Dador the Ordinance 1 of 1894 it was found that persons were infringing the right of thOp Farmezand in congnghee of-that--China ponies; weights as por scale; winners of Quliasace 22 of 1887 was passed by which touch was kept or suppused to be kept of all opium inportal or uxported from the colony. The Orilinnuse Lid down very strictly the course of procare for say person importing, exporting, ot storing opium within the waters of the onlony, and it provided that the Opinn Farmor should un- der all circumstances be maksaare of where the opin us, how it came into the'oulony, and what was being done with it. There were many ways in which attempts were made to evade the Opium. Farmer, and one of these was by taking mea- eures apparently for exporting, carrying the eping to the Obiness junk and getting it marked and then bringing it back into the colony. In the present case which ogtured on Saturday 1 after sundown, thoro wers all the elements for dorit and the ovalizy of the object for which The Ordinance was passed. Ou that arenitig a gasutity of opium was found in a cargo boat. That apin whether the quantity was large or small wis linble tothe peansties of the Delinanco. On being questioned, the amperego of the boat: prodami sam garit, but not to carry in that' partioalar bost, but in seven different junks. Those permits were granted in senordama with section of tho Ordicanes, and unless the-owners gauld show they had complied with the regula tiens under which these permits were granted they worn at fault. The Ordinance must be construed strictly, and the simple question wow whether the. Ordinance had been infringed or not. It was important that the Ordinance should be carried on to the latter. If it w allowed to be infringed in any particular then they might a well do away with permits al- together.
The following evidence was then takon
Cha Tung exclse offlour No. 3, said that on 14th inst. about 6.30 while cruising about in his launch he wo ergo boat coming from the other side of the harbour. He went alongside wal and they had opizin en board. He asked them for their permit and they showed him the
cou permits produced. He asked if they tad any olhar permit and they said ho hnd not. Ho then took the cargo bost to the Yanmati Tolinė Station and the Timpactor there took poɛnossion of the oplam. There were thirty-two obeste in all. The chests were not envorod in ganay bags as is usual when they are to be exported. The number of the best was 124.
Cross-examined by Mr. Ewens-I went mi hard the cargo boat as the agent of the Opinu Farmer. I had no warrant I saw the permita had a chop on the authorising them to take tha "opiuut to the Custoas hulk. I know it has hon the custom for some time to pay duty on oplum on board the hulk I have not soon the daryo hoals entering with the opium. I had instruc tions to seize this opinm. I have instructions to seize any opium where the marabors of the permite do not agres. I received these instroo- tions some weeks ago
Fortunato Cordeira olork in the Imports and Exports office, said it was his duty to isme export permits. No pormit was granted to sargo boat No. 121 to carry opinn or to store,
