I have been a Lascar. I was shipped at Madras, and served on board the brig Starlight for one year, as a tindal. I saw the board the Harlequin in this harbour, about 8 months since. He came on board willingly. I don't know what pay he was to receive. I don't know that he was dissatisfied. Manilamin always shipped as seacunnies. I considered the prisoner in other Manilamin. I never heard that Mr. Stopkins had struck the prisoner before the day of his being stabbed by the prisoner. I do not remember the day of the month, it was on a Friday, in the month. I was on a voyage to Pulo Pangan.

I was at anchor in the Namno straits, and nearly all the crew were on deck at work. It was about half past six in the morning. I saw Mr. Stopkins strike the prisoner three different times. The prisoner was cleaning the gratings. Mr. Stopkins struck him with his fist as well as with his open hand. I was on the deck, then bringing water on trine, and was about 18 feet from the parties. Mr. Stopkins walked away from the prisoner after striking him the last time; and I saw the prisoner suddenly spring up, when Mr. Stopkins' back was turned from him, and when Mr. Stopkins was about 10 feet distant, and closing with Mr. Stopkins. I thought, from the prisoner's action, that he had struck Mr. Stopkins with his fist. I did not see his knife then. Mr. Stopkins called out "seize the scoundrel", and I then supposed he had been stabbed.

There was a short struggle between Mr. Stopkins and the prisoner, and when I neared the parties, Mr. Stopkins had hold of the prisoner's arms, and the prisoner's back was towards...
