In humble obedience to Lordship's request we have taken these matters into our consideration and have now the honor to report

The object of the Order in Council appears to me to be to

the power to act is

The power to try and punish British Subjects, who may be guilty of criminal offences,

and also to decide any civil differences or suits between British Subjects, and between British Subjects and the Chinese.

This Order in Council would be operative so far as to designate and point out the Officers in whom the judicial power is to be vested,

but in order to make it properly effective it would require either that their commission or some other document of a legislative character should define more clearly the degree of power which it is intended to bestow in them,

and also the course of judicial proceedings to be adopted by them, and the manner in which their judgment or sentence is to be carried into effect.
