Since
the deductions prescribed by the
#Cap. 244 Sec. 27
should be made from their Salaries, and it cannot be left to the choice of each individual whether
or not
he will be placed on the List of Persons entitled to superannuation. According to the usual practice in such Cases all the persons belonging to a Public Establishment (with the exception only of Foreigners and other persons peculiarly circumstanced, such as a private Secretary
or aide
de Camp to... removable with, or at the pleasure of the Governor Chief Superintendent) must be brought within the provisions of the Superannuation Act,
none must be excluded.

It is also necessary
to observe that according
to the
rule uniformly acted upon by
My Lords in applying the provisions
of
the Superannuation Act, the rate of pension to be ultimately
allowed, must be determined by the number of years Service for which the deductions have been paid, and if any of the Members of the Hong Kong Establishment, as it has now been settled, should desire to have their Public
Services hereafter taken into
account in fixing the amount of their pensions, for any period prior to their being placed
on that Establishment, it will be necessary for My Lords to be furnished without delay with a detailed Statement of the period of service which may be claimed to be allowed in every such case, and for the parties to pay, within a reasonable period, to the Colonial Treasury, the arrear,
