"The distinction in the jurisdiction over
the people of Hongkong should be preserved on the footing before agreed upon. Upon this subject several discussions took place while still at Nanking; and afterwards during the High Commissionership of the late Sir Henry Pottinger, the subject was further discussed between him and the Honble Plenipotentiary; when it was arranged that when the people aforesaid should be found guilty of offences, they should be given over to the Chinese Officers to be tried & punished; to which arrangement the Honble Plenipotentiary's reply appears on record. After this, when the present High Commissioner had reached Hongkong, he received a Memorandum from the Honble Plenipotentiary in which several rules were stated; among others regarding registration of the population, the arrangements regarding which were very proper. But it was also therein contained, that if the old inhabitants of Hongkong be willing to remove, the value of their ground shall be ascertained and paid to them, and they shall be free to remove to the mainland; but such as shall be unwilling to remove...
