At the time the transfer tour was made, which was only four months after the date of the original grants to Capt Teik, His Excellency was absent at the north on important Public service, and his authority here was necessarily delegated to others, by whose acts H. E. is bound, as far as regards though they were his own for whose sanction we should have applied in the same manner, before completing the purchase, had His Excellency been present. The Head of the department during this walling "absence, after due investigation, at the time the walls built by Capt Teik were still standing, and his operations on the ground were apparent, gave his decision officially that he had a right to dispose of it, and the transfer was accordingly formally made by the Land Officer, who was specially authorised by His Excellency to register sales and transfers of land.
I hope I am not presumptuous in supposing that as principle of law or Justice will justify a superior repudiating the acts of his constituted officers acting in a manner specially and publicly authorised by him, to the injury and loss of a third party who has relied on the faith of these acts.
