communication (of date 6th January Inst.) was addressed to Mr. Kinsley and myself by command of His Excellency, in which His Excellency modifies his previous intention of having the land sold by Public Auction: acquainting us that the decision of the matter would be left to the determination of H.M. The Queen, in the following words which I quote from the letter of His Excellency's Secretary.

"With reference to your claim, as based upon the fact of the transfer having been affected under the sanction of the Head of the Fort, he desires me to intimate to you that the confirmation of such acts must still rest with H.M. The Queen, to whose foot the circumstances of the case will hereafter be transmitted."

Having perfect confidence in my title to the ground in question, as resting on the above foot documents, I was proceeding with the Erection of the Building upon them, which were far advanced towards completion, when without farther communication from H.E., I had notice given me by the Chief Magistrate of the Colony, that he had been commanded by His Excellency to put a stop to the building in question, accompanied with a copy of His Excellency's instructions then on the subject (of which Annex a certified copy, as it contains the grounds of this proceeding) which also declares the intention of hearing
