The defendants have retaliated with contempt. proceedings against the Collector, and be has been cited to appear before Judge, Sweeny at 8 o'clock, on Monday morning to show cause why he should not be punished for disobeying the mandate of the Court of First Instande.

The issue in the latter proceedings is the jurisdiction of the Court of First Instance over the Collector of Customs. The Collector takes the ground that he is outside of the jurisdiction of the court and on this presumption completely ignored the proceedings held in that court.....
It will be remembered that several months ago Collector Shuster imposed a fine of $200 on the Loongsang for the escape of a Chinaman from the vessel. The fine was arbitrarily imposed, it is alleged, on the mere report of certain Customs officials. The master and agents of the vessel refused to pay the flue and asked for an investigation. There was a form of enquiry at the Custom House and it developed to startling in formation that the Uhinaman, had escaped through the dishonesty of a Customs guard. It was shown that he had paid 150 pesos to be allowed his freedom. Despite this fact the Collector insisted upon the payment of the fine and, when it appeared that he would use his power and detain the vessel, Captain Weigall, the master, and Smith, Bell & Co., the agents, appealed to the Court of First Instance and secured a temporary restraining-order directed against the Collector. Attorney-General Willey took the ground that Collector Shuster had exceeded his powers and so advised him, and no appearaños was made in the case. After the asual time the temporary order was made final, the case having been defaulted by the Collector,
