Counsel's Submissions On Subject Of Duress

A submission on the subject of duress and on the statement of claim was made by the Hon. Leo d'Almada, QC, when he continued his opening address in the claim for the dissolution of the Nam Ping (On Kee) Hotel on the third day of its hearing before Mr Justice J. Wicks at the Supreme Court this morning..

Mr d'Almada, representing six plaintiffs in the claim, said this morning that the plaintiffs pleaded that the arrest of the first plaintiff, Li Kui-po, was brought about at the instigation of the defendants.. He submitted that it was not necessary that duress should be brought about by the other party. The essence of the matter was the absence of consent and not the fact that agreement was forced upon the person seeking to avoid it by the other party.
