On Contract For Cotton Sought
An action for the return of a $10,050 deposit in connection with a contract for the sale of 50 bales of Italian cotton opened before Mr Justice |J. R. Gregg, Puisne Judge, at the Supreme Court
this morning.
The plaintiffs were the Tong Seng Company, of 336 Wang Hing Building, who were represented by Mr S. V. Gittins instructed by Mr A. S. C. Comber of Hastings and Company. Mr Brook A. Bernacchi, instructed by Mr S. Ng Quina, appear- ed for the defendants, the Metropolitan Trading Company, of 501 Bank of China Building.
The plaintiffs claim for the return of the said deposit under
an agreement dated September
1, 1982, whereby they agreed to buy from defendants 50 bales of Italian cotton on condition that the goods would be shipped on or before October 15, 1953. The de- plaintiffs alleged that the fendants failed to carry their part of the contract.
