APPEAL AGAINST FORFEITURE
OF CARGO
An appeal against a forfeiture order made by a Magistrate in respect of a cargo of tinplate seized on board a junk off Sai Wan on June 18, 1952, was heard before Mr Justice C. W. Reece, Puisne Judge, in the Appeal Court this morning.
The appellants, Chang Sul-pun and Chan Cheung-fat, were re- presented by Mr A. J. CHford, Instructed by Mr A. Y. Hon. Mr D. F. O'Reilly Moyne, Crown Counsel, appeared for the Crown. Mr Clifford said that the for- fellure order was made on completely mistaken ground in that the order was applied for under Section 14 (3) of the Importation and Exportation Ordinance when the date of the alleged offence was June 18, 1952, Counsel said that Ordinance had been amended by Ordinance 21 of 1982 which came into law on June 28, 1952.
