CONFISCATION

"In my submission this is a gross breach of natural justice," declared Mr Brook A. Bernacchi before Mr Justice Gould, Senior Puisne Judge, in the Appeal Court this morning. Counsel was appearing for Ko Yat-ming and Chan Yat-tak who appealed against an order made by Mr R. W. S. Winter at Kowloon on July 24 for the confiscation of their motor junk.

Mr Bernacchi explained that Ko and Chan, owner and mortgagee of the vessel, respectively, were not charged and were not heard by the Magistrate as to their bona fides. Two members of the crew were charged with at- tempted export of specified articles, namely, military field telephones and motorcar parts. They pleaded guilty and were fined $1,000 or six months.
