Submissions

ARGUES VALIDITY OF CONTRACT

Speaking for over an hour this morning, Sir Walter Monckton, KC, MP, concluded his opening submissions in the air lines case before the Chief Justice, Sir Gerard Howe. Plaintiffs are the Civil Air Transport Incorporated who are claiming the return of forty aircraft, now at Kai Tak, from the Central Air Transport Corporation.

Sir Walter declared that in December, 1949, before the sale of the aircraft took place, the assets were vested in the de jure National Govern- ment of China. In that view, those who seized them were trespassing and had no shadow of right to possession. "It, therefore, is the quality of the title to possession which is here in issue, not any problem of inter- national law about recognition," added the eminent leader of the English Bar.

"When the new government succeeded to the rights of the old there was no property left to the old government in these assets," Counsel further em- phasised and added that his two main points of argument wero: 1. Validity of the contract of December 12, 1949; and 2. Validity of the

transactions whereby the American partnership of Chennault and Willauer made over the same assets to the plaintiff corporation on December 19, 1949.
