The appeal was brought on the ground that the decision of the Tribunal, which comprised Mr. Jose M. Norrin (Calirman), Mrs. A. Wakseki and Mr. Fre- derlek C. Mow Fung (Members). was wrong in law.

The rent paid in respect of the promisen before the application to the Tribunal was $360 n month. The respondent applled to the Tribunal for a decrease of $240.

In the absence of evidence to prove that the rent payable just prior to December 1941, the Tri- bunal, after viewing the pre mises, came to the conclusion that the rent payable in Decem- ber 1941 could not have been for from $100 a month.

The Tribunal therefore as- sessed the rent payable to the principal tennut at $150, exclusive of rates andl taxes.

It was contended on behalf of the appellant that the respondent was no louter tement of the pre- mlses within the meaning of Ar- ticle 4 (a) of the Proclamation.
