The hearing of the action for libel occu- pied the Judge, sitting without a jury, for six days.
Captain Ramsay complained that a statement in the "New York Times" accused him of treason. There was no plea of justification by the defendant who pleaded qualified privilege and particulars in mitigation of damages.
