London, To-day. Additional details of the North Sea air battle disclose that twin- engined 'multi-gun Messersch- midts, Germany's latest and fas- test fighter, diving with the ad- vantage of the sun behind them, were unable to shake the British bomber formation.

The clash occurred some 200 miles from the English coast.

The British planes met the chal- lenge of the faster Nazi machines by bringing the concentrated fire of several aircraft to bear on the diving enemy fighters.

Even the heaviest close-range attacks were successfully beaten off by the British, keeping "should- er to shoulder" in tight formation. One British plane was hit in the first attack and dropped astern. A second attack was immediately launched on this plane, which was seen to fall into the sea,

The score was evened up a few minutes later when an enemy fighter crashed Into the sea, fling. ing a great column of spray into the air.

At least two other Messersch- midts were damaged but were not seen to crash, and it is as- sumed that it was one of these which later made a forced land- ing in Denmark,

The Eckford case was adjourn- ed for an. hour this morning while the jury inspected the blockhouse where the shooting occurred.

Upon the jury's return the fore- man asked that several passages He from the evidence be read. also requested that Private Stirling be recalled, but on being given the detalls required, said this was un- necessary.

The Crown Advocate summed up for 45 minutes. He said there could be no doubt that Eckford shot Davis but the real point for the Crown was to show that the killing was intentional. ~

Subsequently he detailed corro- boration of various evidence show- ing the killing was intentional. It was not the duty of the Crown, he said, to show the motive for the murder but merely to esta- blish the fact_of_murder.

He pointed out that at no time had accused said the shooting was an accident, merely confining him- self to stating "I killed him." It was difficult to doubt that from the time the rife was loaded, accused Intended to kill Davis.

The Crown Advocate told jury that they had two duties, first to ascertain whether it was mur- der, and the second their duty to- wards the public.

Defending counsel pointed out the responsibilities for the jury. He said there was no doubt that Davis was killed by a rifle held by Eckford, but the shooting was unintentional and unpremedated. of He dwelt on the unreliability
