London, To-day. The British Ambassador to Poland, This morning, Tang Tse-yau, form-Sir Howard Kennard, called at er Police Commissioner and Magis- Foreign Office yesterday. trate at Shum Chun said that on August 2 he gave authority for the sale of some cattle that had been seized. Export of cattle was not permitted under wartime conditions.
He gave the order for the sale at dawn. He did not attend the sale. He had not been dismissed from his post but transferred to another dis- trict, taking part in military opera- tions. He would not state his pre- sent post.
SUPERINTENDENT'S EVIDENCE
Li Sun, Superintendent of Police at Shum Chun, said that as the re- sult of information he led a party of police to Li Tong. He had with him a warrant for the seizure of any contraband goods. At 3 a.m. he saw some men leading cattle towards British Territory. He tried to stop the men, but they ran away, It was a dark night. The cattle were taken to Shun Chun. The Commissioner of Police ordered the sale, and the cattle were sold at 6, a.m. to Ng Wan-sin for $2,000 Chinese Currency.
In answer to Mr. Russ, witness said that, in his opinion, the cattle belonged to the purchaser after the sale by the Police, and the previous owner had no claim to them.
'PLAINTIFFS' ALLEGATIONS Cross-examined by Mr. Silva, wit- ness admitted that Ng Wan-sin was not supposed to take the cattle into British Territory, but if he was clever enough to smuggle them out, witness could not help it.
He agreed that Ng Wan-sin had come to him for help when the cattle were seized in British Territory. He came to Court to help defendants às they were accused of having stolen the cattle."
In reply to Mr. Fraser witness said he could not state why he had not arrested Ng Wan-sing when he made the report, as the latter had been guilty of an offence.
He denied that the whole business concerning the cattle involved graft on the part of the Chinese Police or that the cattle were driven straight into British Territory,
Witness also denied that Ng Wan- sing, was only a figure-head to com- plete a fraud.
The case is continuing..
