VISCOUNT HALIFAX TELLS LEAGUE BRITAIN IS AT WAR
THE FOLLOWING LETTER has been addressed to the Se- cretary-General of the League of Nations by the di- rection of the Foreign Secretary:

"On May 23, Viscount Halifax made, called into play the obligations which on behalf of His Majesty's Government His Majesty's Government in the in the United Kingdom, a statement to the Council of the League of Nations concerning the obligations which His Majesty's Government had felt cons- trained to undertake in pursuit of pacific and well defined ends.
He explained that one principle was common to these obligations, namely resistance to the imposition of solutions by the method of force which, if con- tinued, must result in reducing civili- zation to anarchy and destruction.
He added that everything that His Majesty's Government in the United Kingdom had done was in conformity with the spirit of the Covenant.

"These obligations, which originally resulted from the declaration made by His Majesty's Government
on 31st March. 1939, were defined in an agree- ment of mutual assistance between the United Kingdom and Poland signed in London on 25th August, 1939.
"I am, therefore, to inform you that in conformity with the obligations as- sumed by His Majesty's Government in the United Kingdom and in conse- quence of the continuance of aggres- sive action by Germany against Poland a state of war has existed between the United Kingdom and Germany since 1 a.m. on 3rd September, 1939. I am to request that this communication may be fransmitted to League of Nations."

Mr. P. M. Hodgson pleaded guilty on behalf of the defendant.
It was said that the code found in defendant's possession was for com- mercial purpose.
Mr. Hodgson told the Court that defendant was about to proceed to America for further education. He had a very high reputation in the Colony, and did not want anything to mar his future career. He asked the Court to register a technical con- viction.
His client had already informed his friend in Shanghai not to send any more telegrams in code, immediately after the notice in the "Government Gazette." All the telegrams were for commercial purposes only.
