VEXED QUESTION OF SANCTIONS

"CHINA MAIL * SPECIAL.
Geneva, To-day.
Another one of the League of Nations" various committees
the end of its! has reached tether, the League Secretariat having just published the re port of the committee of jurists appointed by the Committee off Thirteen in order to examine the question of whether any measures to be taken by the -League Council under Article). XI of the League Covenant against a State guilty of unila- teral repudiation of interna- tional obligations can be pre- vented by the negative vote of the guilty State
The committee of jurists re ports that it failed to reach agree- ment since it proved impossible to of reconcile the opposing views two groups, of which one the Franco-Russian group-maintained that the vote of the State which! had endangered the peace should not be taken into consideration, while the other group insisted that under the explicit provisions of of the Article Vall decisions

the League Council as League Assembly must be taken by
a unanimous vote...
MORAL WEIGHT
It was pointed out by this group that any measures advocated by all the members of the League Council, with the exception of the! State charged with repudiation of its treaty oblications, would carry and moral sufficient political weight to condemn the guilty State.
One member of the committée suggested that the question be submitted to the International Court at The Hague, but the sug- gestion found no favour since it was held that the League Assem- bly alone was competent to give an. interpretation of the League Covenant.
I view of the divergencies of opinion the committee refrained from putting the question to the Tote.
