Obstruction On Foot-Path

Appearing before Mr. A: W. G. H. Grantham at the Kowloon Magistracy this morning, Mr. H. H. Mundy, of Messrs. Dodwell and Company, residing at No. 26, Hankow Road. top floor, pleaded not guilty to two summones against him, for creating a ruf» sance by throwing'a quantity of house rubbish into the street from No. 20, Hankow Road at. 12.45 p.m. on January 29, and for causing obstruction by leaving n large packing case on the foot path of Hankow Road ut the same time. but after the evidence of the Indian constable he was discharged on both counts.

In his evidence the constable stated that at about 12.10 p.m. on the day in question he was on duty in Hankow Road when he saw five coulies with a large packing case and a frigiduire on the foot path. He went up to them and cautioned them to remove the box. When ba returned about half an hour later the box was still there, and he saw a coolle throw some rubbish on to the road." He arrested the coolle and after making him pick the rub-, bish up started to take him to the police station!

On arriving at the junction of Peking Road and Hankow Road, the constable said the defendant stop- ped him and released the coolie and asked what the matter was. The constable handed his book to the de- fendant and asked him, in English, to put down his name and address, which the defendant did. At 4 p.m. on the same day, when he went off duty, he reported, the matter to In- apector Stimson, who is in charge of the Water Police Station.
