The case for the prosecution in the Haupt- mann trial ended yesterday upon which counsel for the defence made an immediate demand for a directed verdict of acquittal, declaring that there was no evidence.
The court had jurisdiction in the case, he said, and he claimed that there was no proof that ac- cused was present at the scene of the crime at the time it was committed.
The prosecution contended that Hauptmann was guilty be- cause he broke into Colonel Lindbergh's house with intent to sleal, subsequently committing battery on the baby and if they had no living soul who saw Hauptmann they had the nursery note in his handwriting, the fact that he built the ladder used, and got from him the sleeping-sult the child was wearing when last seen alive. The Judge thereupon denied the motion for acquittal.
