"An appeal --- arising out of the Fung Murder Trial, which has aroused great interest in the Colony--- based on grounds that the evidence generally of the witnesses, Edward Zimmern and Sydney Christie, was inadmissible, and that the Chief Justice erred in refusing to withdraw the case from the jury, commenced before the Full Court at the Supreme Court on August 29. The Cldef Justice, Sir Joseph Kemp, K.C., and Mr. Justice Wood (Pulsne Judge) presided.

Defence counsel, led by Mr. Eldon Fötter,- K.C., are seeking to quash the conviction of Cheng Kwok-yau, 'on a charge of procuring the murder of George Fung at Village- Road on the night of March 24. Mr. Potter submitted that the Crown had endeavoured to prove by evidence concerning *one crime that the prisoner was gulity, of another. The agency, he said, between the accused and the man Lan, formed the kernel of the case, and his submission was that the Crown had failed to prove that agency. Evidence of motive and overwhelming evidence of hatred even did not go to prove agency,

Mr. F. C. Jenkin, K.C., also defending counsel with Mr. Potter, sharply criticised the Trial Judge's summing-up; and ventured to say that the gentlemen of the jury entered the library for their consultations with blurred and con-

fused minds as to how they could rightfully apply any part of the evidence on the issue before them. The case, he said, was a very long and difficult one.

Replying for the Crown, Mr. H. G. Sheldon, leading counsel, disputed the difficulties of the case, saying it was nothing more than an ordinary murder trial, distinguished only, perhaps, by the fact that the charge was one of acces sory before the fact, and by the essence of cowardice and cruelty. He submitted that the evidence of two crimes, with one end in view, was always admissible. The evidence of Zimmern and Christle was admissible on various grounds. Legislation has been framed which, when it becomes law, will give Hong Kong a divorce law, thus turning a new/ page in the history of the Colony. The Supreme Court of Hong Kong will be empowered to act in all matters per- taining to matrimony, much the same as does the High. Court of Justice in England. The Divorce Ordinance, which was gazetted on August 27, under its clauses, states that divorce may be sought on the grounds of adultery, the co respondent to be made in the proceedings, except in certain exceptional circumstances. The Ordinance is given in the OVERLAND CHINA MAIL.
