The Board finds that the coast- guard cutter acted in a perfectly legitimate manner and commenda the boatswain, Karl Schmidt, who was in charge, for the care he took of the wounded captain. | The Board finds he was not in- toxicated, and recommends that no disciplinary action be taken against any member of the crew.
The Canadian Premier, Mr. Bennett, refused to comment on the report of the Board. The matter, he stated, would be dealti with through the regular chan- nels. An official protcat is expect-1 ed to be made to the State De partment.
The report is couched in such language that the Canadian Gov- ernment has little option in the matter. The Board of investiga- tion defends the action of the coastguard by stating that the capture took jlace "within the twelve-mile limit."
A convention signed at Wash- ington in 1924 acceded to the re- quest of the United States for the right to search beyond the three- mile limit provided the vessel searched was less than an hour's sailing distance from the coast, to extend is territorial waters The right of the United States
