DESTROYED MACHINERY.

Replying to the Asiatic Insur- ance Company's defence that the premises were used as A motor garage, in the case in which Kwak Ku-loong (trading as Tuck Lee and Co, Singapore, are claiming from that insurance com- pany $21,000, the sum for which plaintiff's factory at Outram Road was insured, Mr.

H. Eattishill said that in a photo graph taken after the factory was destroyed by fire two lorries were shown. One had been backed up

against a platform in the ice fac tory portion of the building; it had been backed up there pre- paratory to being loaded with ice. The other lorry was a little distance away.

at

The fire happened between two and three o'clock in the morning People who sold ice began bus would be that they started ness very early, and the evidence about lorry was about to be loaded and that time. and that one

the other was awaiting its turn when the fire broke out.

The only man actually on the scine was an ollman working in the ice factory, and he would des- cribe what he knew about it. He did not see the beginning of the fire, which was started by the falling of an oil lamp.

There was another matter, pro- creded counsel, and that was that at the time of the fire there was a car in the vermiceli factory portion of the building. With re- gard to that, it would be stated that it was an old car undergoing repairs, and that its engine bad been taken from it; there was no petrol in the car.

near where it was found the build. ing was most badly burnt.

Hla Lordship: Was the beam burnt through?

Witness replied in the afirma tive.

to

His Lordship pointed out that the burning through of the beam might have caused the lamp fall, and added: "Witness forms the opinion that the fire was caus- ed by a falling lamp because one was found on the ground, near a beam from which it had been hung and which was burnt through."

The plaintiff, giving evidence. said he insured with

the defen- dants in consequence of visita by one of their agents. All details were discussed with the agent. The defendants' manager, aa wit- ness was at the time informed he was, merely visited the place, after the agent's visit, had a look round and went away.
