ARGUMENT ON EVIDENCE
CALLING NEW WITNESSES
This morning Mr. E. W. Hamilton resumed hearing in the extradition case in which the Canton authori ties are seeking the surrender of a Chinese for alleged armed robbery and murder of a young woman in Numhoi in April 1927.
The man was arrested whilst em- played as a coolle at the Grand Theatre, Wanchal, and his reply to the allegations agalast him was that he was employed at the theatre dur-
ing the whole of April, 1927, and had never been back to his native
village since the beginning of 1927 when he first arrived here. His aliki was supported by a foki of the Grand Theatre.
This morning Mr. L. R. Andrewes, Assistant Crown Solicitor, proposed to call Mr. C. S. Rosselet, Secretary, Hong Kong Amusements. Ltd., Mr. Tung Chi-kwan, former manager of the Grand Theatre, and others con- neeted with the theatre to rebut the alibi set up by the defence.
Objection on Principle
Mr. Hin-shing Lo, who appeared for the alleged fugitive, instructed by Mr. Horace Lo, objected on prin- ciple, to the culling of these wit- nesses after the cases on both sides had been completed.
Mr. Hamilton pointed out that subject to the production of more evidence favourable to the defence he was bound to commit the alleged fugitive. He suggested that in the circumstances it could not possibly do Mr. Lo's client any harm to admit the fresh evidence. On the con- trary, something might be elicited from the witnesses that might turn out to be the additional favourable evidence required to swing the case in the favour of the defence.
Mr. Lo pointed out that Mr. Andrewes's purpose in calling these witnesses was to destroy the alibi Het up by the defence and he was bound to object on principle. However, the matter of the admis- sion of this rebuttal evidence was one entirely for the Magistrate's discretion, and if his Worship thought he wanted that evidence, he (Mr. Lo) would be in Mr. Hamil- ton's hands.
A Suggestion
Mr. Andrewes remarked that in the case of the, man Tang he un- derstood that it was agreed on both sides that this man should be found, and the Crown had found him. To get over the difficulty he suggested that all the now witnesses should be treated as Court witnesses.

The Magistrate adjourned the Court for Mr. Lo and Mr. Andrewes to look up authorities on the point of rebuttal of evidence.
