In his evidence, Sgt. Scrim said, that on August 21, at 11.30 a.m., he was on motor cycle patrol in Chatham Road. Just as he passed out of the controlled area, at the. children's playground, he Wire. saw defendant's machine approaching, On demand at a rather fast speed. De- fendant also said that his speed was only 12 m.ph.
Defendant's version of the story was a complete denial,
At this stage, Mr. Calthrop put a question to defendant.
Mr. d'Almada objected, saying that the officer only held a watching brief and, that being so, he was not entitled to crom-examine a witness. His Wor- skip upheld the objection.
The case was then adjourned until Friday next.
MUI TSAI CASE
CHARGE OF CRUELTY.AGAINST A MAN
"KICKED" AND BEATEN ?
Yesterday afternoon, Mr. T. M Ifazlerigg heard evidence in the ad- journed case in which two Chinese women and a man, the son of one of the women, was summoned by the Secre Lariat for Chinese Affairs, for unlawful employment of a seven-year-old muj tsai. and for cruelty, it being alleged that the mute accused had assaulted the little girl.
The prosecution was conducted by Mr. R. H. Butters, of the S.C.A. Mr. Hin-shing Lo appeared for the mother and son, whilst Mr. A. E. Hall was for the other woman.
Medical Evidence
• Medical evidence was given by Dr. T. W. Ware, of the Government Civil Hospital, who examined the girl. He found injuries to her right eye and shoulder. The bruise to the eye was ac- companied by haemorrhage. It might have been caused by a blow with the fist. On one elbow there was an in- jury which was consistent with a slight kick.
The girl's story was that she was sold to Mr. Hall's client when about six years old. Last year she was trans- ferred to the Wong family (Mr. Lo's clients). She admitted that on August 18 she was sent on an errand to No. 8, Tung-street. There was nobody there. She saw $6.50 on a table and because she was hungry, she took the money. She spent 50 cents on food.
Ran Away to Yaumati Later, when she was accused by an amah employed at No. 8, Tang-street, with theft of the money, she admitted it and $6 was recovered from her. She was not beaten for this. Then, the male accused returned home, and be- cause she did not open the door wide enough for him, she was beaten with a eane and kicked in the eye and on the elbow. After the assault, she ran away and went to Yaumiati where she met a woman who took her to the Police.
The case was adjourned.

Before Mr. T. S. Why-le-Smith, at the Kowloon Magistracy, yesterday, Mr. J. Guerineau pleaded guilty" to dangerous driving of a motor car in Nathan-road, and falling to sound his born when rounding a corner at the junction of Nathan and. Water- loo-roads.
Traffic Sergeant Scrim said that defendant did 40 miles per hour when approaching the Po Hing. Theatre, slowed down to 35 when passing the Majestic Theatre, and then again accelerated to 40 miles.
The Magistrate imposed a fine of $15 on the charge of speeding, and defendant was cautioned on the other count.

In a case of alleged negligent driv ing heard by Mr. T. S. Whyte-Smith, at the Kowloon Magistracy, yesterday, there was some argument between Mr. T. G. Bennett (for the defence) and the Magistrate on the relevancy of evidence of injury received in an aeci- dent. Mr. Bennett submitted that such evidence should not be taken into con- sideration in meting out punishment in such a
case, but Mr. Whyte-Smith maintained that the extent of injury
served as guide to the extent of the “ negligence.
