U.S. MEMORANDUM
A "NOTORIOUS SMUGGLER AND LAW-BREAKER”

In a
Washington, Yesterday.
memorandum, Mr. A. Mellon, Secretary to the Treasury, declares that the "Imalone" was à notorious smug- gler and law-breaker and not only a thorn in the side of the United States but she had actually got into trouble with the British authorities over false clearances from British ports.
The "Imalone" was within 12 miles of the Louisiana coast when she was first hailed. The "continuous pursuit was precisely according to the well-known doc trine of international law. ensued until the "Imalone" was overtaken and again defied the United States authority."
The memorandum quotes the ap- plication of the same doctrine when the British Columbia Admiralty
Court, in 1926, condemned the American ship "North" and the decision was upheld by the Supreme
Court of Canada.
Captain Allowed Bail
Washington, Yesterday. Captain Randall, commander of the "Imalone," has been released on bail of $500 and the crew of seven released on their own recognisances.
The conduct of the Imalone case has been transferred from the British Embassy to the Canadian Legation.
