His Worship decided to amend his order to one for return of the notes to defendants (If genuine) after due liquidation of the defendants' debt to the Cafe.

Sergeant Whant said that the point he wished to make was that if the notes were forgeries, the Cafe would be the losera.

Mr. Hamilton replied that he pre- sumed that actually the Cafe had a civil claim against one of the de- fendants for the recovery of the debt if they chose to take that up.

Mr. d'Almada Concurred

Mr. Worship then instructed Ser- geant Whant to sign a receipt be fore Major Willson for custody of the two notes.

In conclusion his Worship sald that he wished to make it clear that his order did not in any way pre- vent the Cafe from taking civil pro- ceedings as to the debt.

Mr. d'Almada said that he had no doubt that the complainants would be advised by the police as to what steps to take.
