At the Centrul Magistracy on Saturday Mr. R. E. Lindsell decided to commit F. Chan to stand his trial at the next Criminal Sessions on a charge of conspiring with one Yeung (deceased) and others to ruin the trade of the Wing On Company by securing by unlawful means the transfer of a part of the business of Wing Oo's Ship Chandlery Department to a new firm styled F. Chan and Company" the accused opened in which Gilman Street.
Mr. F. C. Jenkin prosecuted on behalf of the Wing On Company while the accused was represented by Mr. M. K. Lo,
Copied Wing On's Prices. In cross-examination, accused told Mr. Jenkin that "F. Chan and Company's" price list was drawn up by him and he copied the names of goods from a pencilled list of Wing On's marked "Dollar-June" which he took from a drawer in Yeung's desk. He also copied Wing On's, prices to facilitate his work.
Mr. Jenkin suggested that cused copied Wing On's prices in order to undercut them, and ac- cused agreed that that was so, and added that his prices were the same as Wing On's 1926 prices. Mr. Lo then submitted to his Worship that the accused had given a complete answer to every charge that had been brought against him, and said that there was nothing to sustain the case for the prosecution before a jury and justify their re- turning a verdict against the ne cused. Even if such a verdict were returned, Mr. Lo suggested that it would be based on such uncertain; ground that it would not be upheld in the Appeal Court and was bound to be reversed.
Mr. Lindaell decided to commit the accused for trial.
